Here is a brief update on important procedures concerning the 2nd lockdown: 

In the first lockdown, GEMA had announced that customers who have a license agreement for music in classes can use this license to show online courses without having to purchase an extra online license. We had asked GEMA in mid-October whether this regulation would also be valid in the subsequent lockdowns. We did not receive an answer until almost 3 months later.

The answer from GEMA is: No, licensees have to apply for an online license for everything they had online after the first lockdown and will have in the future.

GEMA also assumes that for the period of the first lockdown, the course license covered the licenses for online courses, so they would not refund any of those payments unless you filed a legitimate claim for a partial refund.

Class licenses that have already been paid for subsequent lockdowns are eligible for a regular refund. This results in the following for fitness centers:

  1. For the first lockdown, calculate whether fewer classes were shown online than were licensed for classes in the studio. If so, which is very likely, a corresponding list with details of the classes must be submitted to GEMA and a new statement with reimbursement of the difference must be requested.
  2. For all subsequent lockdown periods, the entire prepaid classes license must be reclaimed.
