Why can GEMA demand fees from you at all? A short excursion into the history of artists and their helpers.
Many, many years ago, when there was no way to record music, many things were easier. Minstrels and other bards stood on the market place and performed their art live and "unplugged".
Often there was a little boy with a tin cup who walked through the audience rows begging for small donations for the performance. According to the musical qualities of the singer and the pleasure of the audience, some coins tinkled in his cup.
If the artist did not sing, there was no reward. Today, on the other hand, modern recording, reproduction and broadcasting technologies make it possible to listen to an artist's music even when the person who composed and recorded the music is not even present. This creates a financial "reward vacuum", which means a financial disadvantage for composers and musicians.

Die Bands von damals gibt es nicht mehr – der kleine Kerl jedoch ist immer noch unterwegs. Er hat sich mit einigen Tausend Gleichgesinnten zusammengetan (siehe Info unten). In Österreich zum Beispiel nennen sie sich AKM, in der Schweiz SUISA und in den USA BMI oder ASCAP (Liste der deutschen Verwertungsgesellschaften). Und in fast allen anderen Ländern der Welt gibt es weitere Kollegen.
Es ist eine wirklich gute Sache für die Künstler, die „ihre“ Verwertungsgesellschaft beauftragt haben, für sie Lizenzen für das Abspielen ihrer Musik zu kassieren – denn wenn irgendwo auf dieser Welt ein Stück von ihnen gespielt wird, klingelt es in der Kasse. Für jede erdenkliche Art der Musiknutzung hat die GEMA einen passenden Tarif entwickelt. Da kann schon einiges zusammenkommen. Allein in Deutschland landeten im Jahr 2018 über eine Milliarde Euro allein in der Deutschen GEMA-Kasse.

GEMA is the German "Society for musical performing and mechanical reproduction rights". As a state-recognised trustee, it has been administering the exploitation rights of musicians for over 100 years now.
GEMA is a collecting society. It has the legal form of a commercial association. Its work is subject to supervision and control by the German Patent Office, the Federal Cartel Office, the Berlin Senator of Justice and the General Meeting of GEMA.
Die Tätigkeit der Verwertungsgesellschaften bestehen aus zwei Hauptaufgaben:
1. Wer auch immer Musik öffentlich abspielt, muss die Rechte zur Musiknutzung bei der GEMA erwerben. Ob Kneipe, Supermarkt, Radiosender oder Fitnessclub – für alle gibt es spezielle Tarife, die sich nach der geschätzten Anzahl der Hörer richten.
